LEGAL PROCESS FOR ITALIAN CITIZENSHIP
Italian citizenship is a right for all descendants of emigrated Italians, without generational limitations (nationality by blood). Prior, the condition for citizenship was that the first ascendant born in Italy had died, in Italy or abroad after March 17, 1861, the day in which the Kingdom of Italy was founded.
To obtain recognition of their right, descendants must provide documents proving that their family tree includes Italian lineage. There are times when it is not possible to obtain Italian citizenship (i.e. maternal ancestry or illegitimate children) through the Italian Consulate, which is to say through an administrative channel. In such cases, Italian citizenship must be recognized by a verdict handed down by an Italian court. The Italian legal system allows dual citizenship, so those who obtain it will not be required to renounce their own citizenship.
